La garanzia per vizi o difetti di cui all’art.1490 del Codice Civile, copre i
prodotti e le singole parti di questi per un periodo di 24 mesi dalla data di
spedizione dalla fabbrica.
La garanzia di buon funzionamento degli apparecchi accordata dal
costruttore, s'intende nel senso che lo stesso s'impegna a riparare o
sostituire gratuitamente, nel più breve tempo possibile, quelle parti che
dovessero guastarsi per difetto di costruzione o vizio di materiale,
durante il periodo di garanzia. L'acquirente non può vantare diritto ad
alcun risarcimento per eventuali danni o altre spese. Sono escluse dalla
garanzia le parti fragili o esposte a naturale usura come pure ad agenti o
procedimenti corrosivi, a sovraccarichi anche se solo temporanei,
ecc...
Il costruttore non
risponde per eventuali danni causati da errato montaggio, manovra o
inserzione, da eccessive sollecitazioni o da imperizia d'uso.
Il costruttore non risponde se il prodotto è stato manomesso, smontato,
privo di etichetta o comunque con segni evidenti di urto od altro. Le
riparazioni in garanzia sono sempre da intendersi "franco fabbrica
produttore". Le spese di trasporto relative (andata/ritorno) sono sempre
a carico dell'acquirente.Per eventuali sopralluoghi di personale
specializzato resta a carico del costruttore il costo di mano d'opera, fatta
eccezione per i luoghi non facilmente ispezionabili che rendono onerosi
gli accertamenti e le manutenzioni del caso. In ogni caso debbono
essere rimborsate le spese di locomozione (andata/ritorno), le ore di
viaggio, e le spese di vitto e alloggio. La garanzia è valida solo se il
presente modulo, facente parte delle istruzioni per l’installazione e
l’uso, è compilato in tutte le sue parti ed è stato specificato il
motivo del guasto lamentato.
I prodotti devono essere installati e usati nel rispetto delle
caratteristiche tecniche e istruzioni impartite da TOPP, nonché secondo
l'osservanza delle norme di sicurezza e le disposizioni, che regolano
l'installazione e l'uso d'apparecchiature elettriche, in vigore nel paese
dove i prodotti sono installati e usati. A tal fine l'acquirente solleva
espressamente TOPP da qualsivoglia responsabilità in ordine agli usi
impropri, alla mancata osservanza delle norme di sicurezza, delle
specifiche tecniche e delle istruzioni per l’installazione e l’uso.
La garanzia non è operante qualora il sensore presenti segni di
usura dovuti all'esposizione alle intemperie ed alla luce del sole
(opacità delle colorazioni e/o deformazioni sugli involucri esterni,
presenza di scoloramento, chiazze opache, fessurazioni e/o porosità
sulla superficie sensibile del sensore pioggia).
The warranty for the products, and their single parts, defective for poor
materials or manufacturing defects is extended for a period of 24
months from the date of dispatch by the manufacturer.
The manufacturer provides that the products are reliable, which means
that he undertakes to repair or replace free of charge any of the parts
proved to be defective in materials or manufacturing during the warranty
period, in the shortest possible time. The purchaser shall not expect any
refund for any damage due to improper installation or any other
expenses. Such warranty will not however apply to any particularly
fragile parts, or to parts exposed to natural wear as well as to corrosive
operations and to current overloads (even if only temporary), etc. The
manufacturer shall not be considered liable against any damages due
to improper installation, manoeuvring or insertion, as well as to
excessive solicitations or misuse.
The manufacturer shall not be liable if the product has been modified,
dismantled, if the label is missing or if it shows clear signs of collision or
other. Repairs under guarantee are considered "ex manufacturer's
factory", which means that all the arising transport expenses (in- and
outward) are always to the purchaser charge. For any inspections by a
skilled staff, cost of labour shall be to the manufacturer charge with the
exception for places not easily reachable where verifications and
maintenance may be onerous. Displacement costs (in- and outward
journey), journey hours, board and lodging must, on the other hand, be
refunded from the purchaser. Such warranty has validity only if the
present form, being part of the instructions manual, is duly filled in
and the damage cause is clearly described in the assistance
report.
The products must be installed and used in compliance with the
technical features and the instructions given by TOPP, as well as
according to the safety regulations and the standards that rule the
installation and employment of the electrical devices in the country
where the products are installed and used. For such reason, the
purchaser expressly relieves TOPP from any responsibility arising from
improper use, from the inobservance of the safety regulations, of the
technical specifications as well as of the operating instructions.
Such warranty shall not apply if the
sensor shows wear signs due to bad weather and sun light (opaque
colours and/or deformation of the outside casing, fading, opaque spots,
cracks and/or porosities on the sensitive surface of the rain sensor).
